Silverstein separated from his business partner, Bernard Mendik, in 1977, and bought a series of large office buildings in Midtown and Lower Manhattan in the late 1970s. In 1980, Silverstein won a tender from the Port Authority of New York and New Jersey to build the World Trade Center 7, north of the twin towers. Silverstein was interested in acquiring the entire World Trade Center complex, and placed an offer when the port authority put the resort up for sale in 2000. Silverstein won the tender when an agreement between the initial winner and the port authority did not materialize, and the contract was signed on July 24, 2001.

Silverstein also had multiple disputes with other political parties, including with the port authority. In an agreement reached in April 2006, Silverstein retained the rights to build three office towers (Four World Trade Center, Three World Trade Center and Two World Trade Center), while the One World Trade Center belonged to the port authority, just like tower five, which could have had the option of being leased by a private developer and converted into a residential building.
